As of a string of federal court rulings ending (for now) in April 2026, premium handmade cigars sit outside the FDA's "deeming rule"... the regulation that governs cigarettes and most other tobacco... and for the first time, a US court has pinned down exactly what counts as a premium cigar.
How we got here, in four steps
2016. The FDA "deemed" essentially all tobacco products under its authority... cigars included, from machine-made gas-station sticks to hand-rolled premiums... bringing premarket review, user fees, and warning-label requirements with it. The industry sued.
2023. Judge Amit Mehta of the D.C. federal district court vacated the deeming rule as applied to premium cigars. The core of the ruling: the FDA had ignored evidence in front of it... including its own commissioned research showing that premium cigar users smoke far less frequently than other tobacco users... and regulated the products as if they were interchangeable with cigarettes. Regulators aren't allowed to skip the evidence that cuts against them; that's the legal principle the case turned on.
January 2025. The D.C. Circuit Court of Appeals upheld the vacatur. Premium cigars stay carved out. The appeals court sent one question back down: what exactly is a premium cigar?
April 2026. Judge Mehta answered on April 15, adopting a narrow, eight-part definition... the industry had pushed for a broader one and didn't get it. A premium cigar, for FDA purposes, is a cigar that meets all eight:
- Wrapped in whole tobacco leaf
- Contains a 100 percent leaf tobacco binder
- Contains at least 50 percent long-filler tobacco by weight
- Is handmade or hand-rolled
- Has no filter, non-tobacco tip, or non-tobacco mouthpiece
- Has no characterizing flavor other than tobacco
- Contains only tobacco, water, and vegetable gum... no other ingredients or additives
- Weighs more than six pounds per 1,000 units
Meet all eight and the deeming rule doesn't apply. Miss one and it does... which is why flavored and infused cigars (line 6) and machine-made cigars (line 4) remain under full FDA authority. As of this page's update date, no appeal of the April 2026 order had been filed, and industry observers consider one unlikely... but check the date at the top of this page before betting a business on it.
What it means if you just smoke the things
Practically, less than the headlines suggest, and more than nothing. The premium cigars on your shelf weren't about to disappear either way; what the rulings removed is a premarket-approval regime that would have made new blends and small releases expensive to bring to market, and that many small makers said they couldn't survive. If you smoke flavored or machine-made cigars, nothing changed for you at all.
The part I actually care about is quieter: for decades, nearly all smoking research lumped every cigar in with cigarettes, which is why good cigar-specific health data is so thin... a problem this site runs into every time a health question comes up. There is now a legal definition of a premium handmade cigar, recognized by a federal court, backed by findings that its use patterns differ. That's the foundation cigar-specific research has been missing. Whether the industry or the government funds that research is an open question, but the category finally exists on paper.
The caveat that keeps this page honest
A court carving premium cigars out of a regulatory scheme is a statement about regulation and evidence, not a clean bill of health. The evidence the court cited says premium cigar smokers use the product differently and less... it does not say smoke all you want. What the health research actually shows, dose by dose, lives on how often is too often and are cigars addictive, sources and all. And legal status can move: this page reflects the rulings as of its update date, and we'll revise it when the next shoe drops.
